Terms of Service

1. Who we are

GrowGodzilla is operated by TMRW MADE LTD, a company registered in England and Wales under company number 17275374, with its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom. In these terms, "we", "us" and "GrowGodzilla" mean TMRW MADE LTD. Contact: support@growgodzilla.com.

2. The service

GrowGodzilla is a software service that helps you grow a product ("the Service"). It analyses your website to build a Product Brain, makes short videos, slideshows and posts for your product (including AI creators and launch videos), plans them on a calendar for the accounts you connect (TikTok, X, LinkedIn and Facebook), posts them when you ask it to, and reports results from the platforms and Google services you connect. Features may change as the product evolves.

3. Early access

The Service is in early access. Some features are still being built, may change or may not always work as expected, and we may adjust usage limits while we learn how it is used. We will tell you in the product or by email before making changes that materially reduce what your plan includes.

4. Eligibility and accounts

You must be at least 18 and able to form a binding contract. You are responsible for your account, for keeping access to it secure, and for all activity under it. Provide accurate information and tell us promptly about any unauthorised use.

5. Connected accounts and automation

The Service acts on your behalf only within the permissions you grant. You control what is connected, and you can disconnect any service at any time.

• You must have the right and authority to connect each account, website and repository you connect.
• Posting: nothing is posted automatically. A post goes out only when you tap Post now: on X, LinkedIn and Facebook we publish it from your connected account; on TikTok we send it to your TikTok inbox and you publish it in the TikTok app. You can also download any post and publish it yourself. You remain responsible for everything published from your accounts.
• Google data: Search Console and Google Analytics are accessed read-only, and only to show you your own reports. See the Privacy Policy for exactly what we access and how.
• Third-party platforms (such as Google, TikTok, X, LinkedIn and Facebook) have their own rules. You are responsible for following them. Posting more often means more activity and may carry more platform risk. We do not guarantee that a platform will not restrict or suspend an account.

6. Your content and AI output

You keep ownership of the materials you provide and, as between you and us, the content generated for you through the Service. You give us a limited licence to host, process and transmit your materials only to provide the Service. AI output can be inaccurate, incomplete or similar to content produced for others. Review it before you publish or rely on it, including any claims, numbers or placeholders in captions and scripts.

7. AI and credits

AI writing, images, voices, AI creators and video rendering are included in the Service: you don't need your own AI keys. Making a video, AI image, AI creator or launch video uses credits, shown before you start. Each paid plan includes a monthly allowance of credits, the Free plan a one-time allowance, and every plan a daily allowance of new ideas. If a render fails, the credits it used are returned. Credits have no cash value, can't be transferred and are not refunded when a subscription ends.

8. Acceptable use

You agree not to use the Service to:

• Break the law or infringe anyone's rights, including intellectual property and privacy rights.
• Publish spam, deceptive, harassing, hateful or misleading content, fake reviews or testimonials, or impersonate others.
• Evade or abuse platform limits, or run coordinated inauthentic behaviour.
• Connect websites, repositories or accounts you do not own or have permission to manage.
• Attempt to disrupt, overload, reverse engineer or gain unauthorised access to the Service.
• Generate or distribute malware, or any content that sexually exploits minors.

We may suspend or limit accounts that break these rules.

9. Plans, limits and billing

Each plan includes the features and limits shown on the pricing page: for example the number of products, monthly credits, daily ideas, and whether Calendar Autopilot, talking-head AI creators, your own AI creators and launch videos are included. The Service enforces these limits automatically for your active plan. If you move to a smaller plan, features it doesn't include stop running and products above its limit are paused (never deleted). Your content and data are kept.

Once you subscribe, paid plans are billed in advance, monthly or annually, at the price shown when you subscribe, through our payment processor (Stripe). Subscriptions renew automatically until cancelled. Taxes may apply. We may change prices with at least 30 days' notice before your next renewal.

10. Cancellation and refunds

You can cancel at any time and your plan runs to the end of the period you paid for. We do not offer a general money-back guarantee, but if we made a billing error or something went wrong on our side, contact us and we will put it right. Details are in our Cancellations & Refunds policy. Nothing in these terms affects your statutory rights.

11. Third-party services

The Service relies on third parties, including hosting, database, email, payment and AI providers, and the services you connect. We are not responsible for their availability, changes or actions, and your use of them is also governed by their terms.

12. No guarantee of results

Growth depends on many things we do not control, including your product, market, competition and platform algorithms. We do not guarantee any view, follower, traffic, user or revenue outcome.

13. Availability and changes

We work to keep the Service reliable but do not promise uninterrupted operation. We may modify or discontinue features, with reasonable notice where practical.

14. Termination

You can stop using the Service and delete your account at any time in Settings. We may suspend or end access for breaches of these terms, non-payment, or legal reasons. When your account ends, your right to use the Service ends and we handle your data as described in the Privacy Policy.

15. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

16. Limitation of liability

To the maximum extent permitted by law, GrowGodzilla will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim and £100. Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded, including consumers' statutory rights.

17. Indemnity

You agree to indemnify us against claims arising from your content, the accounts, websites and repositories you connect, or your breach of these terms, to the extent permitted by law.

18. Changes to these terms

We may update these terms. We will tell you about material changes by email or in the product before they take effect. Continuing to use the Service after the effective date means you accept the updated terms.

19. Governing law

These terms, and any dispute or claim arising out of or in connection with them or the Service (including non-contractual disputes), are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer you may also bring proceedings in the courts of the part of the United Kingdom, or the country, where you live, and you keep the protection of any mandatory consumer laws of that place.
